Privacy Policy & Terms of Use

Welcome to Drift. Fishing Analytics

This page contains both our Privacy Policy and our End User License Agreement ("Terms of Use", "EULA"). These terms govern your use of the Drift. Fishing Analytics App for iOS (the "App"), provided by No Wahala LLC ("we", "us", "our").

By downloading, installing, or using the App, you agree to be bound by everything on this page. If you do not agree, please do not use the App.

PART 1: PRIVACY POLICY

At Drift. Fishing Analytics, we respect your privacy. This section explains how the App handles your data.

1. We Do Not Collect Your Personal Data

The App does not collect, transmit, distribute, or sell your personal data to No Wahala LLC or any third parties. We do not require you to create an account, and we do not use third-party analytics SDKs, tracking software, or advertising networks to monitor your app usage.

2. Local Storage and iCloud Syncing

Any data you generate while using the App—including session logs, fishing location data, catch records, custom notes, and user preferences—is saved locally on your device using Apple's SwiftData framework.

The App offers optional iCloud synchronization through Apple's CloudKit. If you enable iCloud syncing, your app data is securely synced to your personal iCloud account. No Wahala LLC developers do not have access to this iCloud data. It is completely private to you and governed by Apple's privacy and security protocols. Enabling or disabling iCloud sync is entirely your choice.

3. Push Notifications

The App asks for permission to send you push notifications. Notifications are used exclusively to deliver periodic summaries and reminders related to your fishing sessions (e.g., weekly recaps, milestone alerts). These notifications are scheduled locally on your device. We do not use remote push notifications for promotional content, advertising, or unsolicited messaging.

4. Location Data

The App may request permission to access your device's location services for mapping and session tracking purposes. Location data is processed locally on your device and, if iCloud syncing is enabled, stored in your personal iCloud account. We do not transmit, sell, or share your location data with third parties.

5. External Links

The App contains links to external websites and services (such as our website or weather/tide services). Tapping these links will take you outside the App, at which point the privacy policies of those respective services will apply. No Wahala LLC is not responsible for the privacy practices of third-party services.

6. Future Changes

If we add new features in the future that require us to collect data beyond what is described here, we will update this Privacy Policy and provide you with clear notice. We will request your explicit consent before collecting any new categories of data.

PART 2: TERMS OF USE (EULA)

1. License Grant

No Wahala LLC grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with these terms for your personal, non-commercial purposes. You may not sublicense, rent, lease, transfer, assign, or otherwise distribute the App or any rights therein.

2. Informational Purpose Only; Disclaimer of Warranties

The App is a personal fishing analytics and tracking tool designed for informational and recreational purposes only.

Fishing Conditions & Analytics

The App provides data analysis, visualization, and insights related to fishing sessions, weather conditions, lunar phases, and other factors that may influence fishing conditions. All information provided is based on publicly available data and general fishing knowledge. Actual fishing conditions, catch success, and session outcomes depend on variables outside the App's control, including but not limited to: weather patterns, water conditions, equipment quality, angler skill, fish species availability, and seasonal factors.

No Warranty

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. No Wahala LLC makes no warranty that the App will meet your expectations, be error-free, or be available at any given time.

No Liability

No Wahala LLC is not responsible or liable for: unsuccessful fishing sessions, poor catch results, data loss or corruption, decisions made based on App analytics, interruptions or unavailability of the App, bugs or errors in calculations, or any damage, loss, or injury arising from your use of the App.

3. User Restrictions

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, disclose, or otherwise commercially exploit the App or its content

• Copy, modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App, including its source code, algorithms, or databases

• Remove, alter, or obscure any proprietary notices, labels, or marks on the App

• Use the App for any purpose that is unlawful or prohibited by these terms

4. Intellectual Property

All content, features, and functionality in the App—including but not limited to the software, code, design, graphics, icons, images, text, and algorithms—are the exclusive property of No Wahala LLC or its content suppliers and are protected by copyright, trademark, and other intellectual property laws. You may not claim ownership of or modify this content in any way.

5. Apple App Store Terms

Since you are downloading the App from the Apple App Store, the following terms apply:

Apple is not responsible: You acknowledge that this EULA is between you and No Wahala LLC, not with Apple Inc. We are solely responsible for the App and its content.

No Maintenance Obligation: Apple has no obligation to furnish any maintenance, support, or updates for the App.

Third-Party Beneficiary: You acknowledge that Apple (and its subsidiaries) is a third-party beneficiary of this EULA and has the right to enforce this agreement against you.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall No Wahala LLC be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including but not limited to damages for loss of data, loss of profits, or business interruption) arising out of or in any way related to the App, even if No Wahala LLC has been advised of the possibility of such damages.

The total liability of No Wahala LLC for any claim arising out of these terms shall not exceed the amount you actually paid for the App (if any). If you paid nothing for the App, our liability is zero.

7. Indemnification

You agree to indemnify, defend, and hold harmless No Wahala LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these terms.

8. Termination

No Wahala LLC may terminate or suspend your license to use the App at any time without notice or cause. Upon termination, your right to use the App ceases immediately. The provisions of these terms that by their nature should survive termination (including limitation of liability, indemnification, and intellectual property rights) shall remain in effect.

9. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and No Wahala LLC regarding the App and supersede all prior and contemporaneous agreements, understandings, and representations.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Utah.
